This policy outlines our practices concerning the personal data we process and our commitment to being transparent about our data practices. By using our Services, you agree to the collection and use of information in accordance with this policy.

2. Information We Collect

We collect information to provide and improve our Services. The types of information we may collect depend on your role (e.g., student, teacher, administrator, parent) and how you use our Services.

A. Information You Provide to Us

  • Account Information: When you register for an account, we collect information such as your name, email address, password, role (teacher, student, etc.), and school affiliation.
  • Profile Information: You may choose to add more information to your profile, such as a profile picture, contact number, or bio.
  • User Content: We collect content you create, upload, or receive from others when using our Services. This includes assignments, grades, comments, messages between users, and files you upload.
  • Communication Information: If you contact us directly, we may receive additional information about you such as your name, email address, phone number, the contents of the message and/or attachments you may send us, and any other information you may choose to provide.

B. Information We Collect Automatically

  • Log and Usage Data: We automatically collect information when you access and use our Services. This includes your IP address, browser type, operating system, device information, pages you visited, access times, and the referring URL.

C. Information from Educational Institutions

We process personal information about students on behalf of the educational institutions that use our Services. The school is responsible for providing notice and obtaining any necessary consent to provide student data to us. This may include student names, IDs, grades, attendance records, and other education records as defined by applicable laws like FERPA.

3. How We Use Your Information

We use the information we collect for various purposes:

  • To provide, operate, maintain, and improve our Services.
  • To set up and manage your user account.
  • To personalize your experience, such as showing you relevant educational content.
  • To communicate with you, including responding to your comments, questions, and requests, and sending you technical notices, updates, security alerts, and administrative messages.
  • To process payments and subscription fees.
  • For research and development purposes, to understand our users and improve our Services. We will use de-identified or aggregated data for these purposes wherever possible.
  • To monitor and analyze trends, usage, and activities in connection with our Services.
  • To enforce our Terms of Use and other policies, and to comply with legal obligations.
  • We will never use student personal information for behavioral targeting of advertisements to students.

We are committed to not selling or renting your personal information. We may disclose information in the following circumstances:

  • Within Your School Community: Your information may be shared with other users within your school's iSmartClass instance as necessary to provide the Services (e.g., a teacher sharing grades with a student and their parents).
  • Service Providers: We may share your information with third-party vendors and service providers that perform services on our behalf, such as cloud hosting (e.g., AWS, Google Cloud), payment processing, and customer support. These providers are contractually obligated to protect your data and are prohibited from using it for any other purpose.
  • Legal Compliance and Protection: We may disclose your information if required by law, subpoena, or other legal process, or if we have a good faith belief that disclosure is reasonably necessary to (i) investigate, prevent, or take action regarding suspected or actual illegal activities or to assist government enforcement agencies; (ii) enforce our agreements with you, (iii) investigate and defend ourselves against any third-party claims or allegations, or (iv) protect the security or integrity of our Service.
  • Business Transfers: In the event of a merger, acquisition, reorganization, bankruptcy, or sale of all or a portion of our assets, your information may be transferred as part of that transaction. We will notify you of any such deal and outline your choices in that event.
  • With Your Consent: We may share your information with your consent or at your direction.

5. Cookies and Tracking Technologies

We use cookies and similar tracking technologies to collect and use personal information about you, including to serve interest-based advertising. We will retain and use your information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

Student personal information is generally deleted upon request by the educational institution. We also provide schools with the ability to delete student data themselves.

8. Your Data Protection Rights

Depending on your location, you may have the following rights regarding your personal information:

  • The right to access – You have the right to request copies of your personal data.
  • The right to rectification – You have the right to request that we correct any information you believe is inaccurate or complete information you believe is incomplete.
  • The right to erasure – You have the right to request that we erase your personal data, under certain conditions.
  • The right to restrict processing – You have the right to request that we restrict the processing of your personal data, under certain conditions.
  • The right to object to processing – You have the right to object to our processing of your personal data, under certain conditions.
  • The right to data portability – You have the right to request that we transfer the data that we have collected to another organization, or directly to you, under certain conditions.

9. Children's Privacy

Our Services are intended for use by educational institutions, which may include children under the age of 13. We are committed to complying with the Children's Online Privacy Protection Act (COPPA) in the United States and similar laws around the world. We rely on the school to provide consent for us to collect personal information from students under 13 for the use and benefit of the learning environment. If you believe we have inadvertently collected information from a child without parental consent provided through the school, please contact us immediately.

11. Changes to This Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the "Last Updated" date. We will let you know via email and/or a prominent notice on our Service, prior to the change becoming effective. You are advised to review this Privacy Policy periodically for any changes.
